Children

When relationships break down it is not only finances that need to be resolved but also the arrangements for any children. It is hoped that an agreement regarding the children can be reached without the need for Court intervention. However, if it cannot then our family Solicitor will be able to help you in making your application or responding to an application brought by the other parent.

A Child Arrangement Order aims to determine “with whom a child is to live, spend time or otherwise have contact with any person”. The child’s welfare will remain as the paramount consideration when considering any question in relation to the upbringing of a child. It is hoped that the Order will help support parents to agree co-operative arrangements for their children both now and in the future.

Not resolved at Mediation?

If a matter cannot be resolved at Mediation then it will be referred to Court for determination.

What the Court will consider

  • The wishes and feelings of the child
  • His/her physical, emotional and educational needs
  • The likely effect of any change in his/her circumstances
  • His/her age, sex and background
  • Any harm which he/she has suffered or is at risk of suffering
  • How capable each parent of meeting his/her needs
